Should this self-defense be considered legal?

asked:

The 1st Level of Force is Non Lethal with no permanent injury to the attacker. This area of non lethal self defense law is the least restrictive.

The 2nd is Semi-Lethal or less than lethal Force with possible permanent injury to the attacker. This is a very gray area in self defense law.

The 3rd Level of Force is Lethal, when your life is in danger and you must bring grave bodily harm or even death to the attacker. At this level self defense law usually becomes very clear in the fact that you reacted to a life and death situations.

I’ve heard about the rules of self defense, and apparently, what I’ve read is that you are only allowed to use EQUAL amounts of force to confront your foe in a hostile engagement (United States), and I think as a last resort (not sure about this though)?

I’m going to use a hypothetical sitation, so bear with me: A man bears down on me and tries to sexually assault (rape, or whatever) me, succeeding, managing to pin me down without excessive use of force, i.e. nonlethal. Note that he and I both are unarmed. Now, what the self-defense laws says that I am only allowed to use lvl 1 force against him, and only to the extent of him being an “immediate danger to me.”

But seeing as how he has not technically physically harmed me, technically, how I read this is that illegal for me to engage in greater levels of force? So the only thing I am allowed to do is pin him down (or attempt to) and **** him back? What?

So as soon as I start attempting to strike him, I have now violated the law and can be charged with battery a court of law, seeing as how he has never engaged in anything but non-lethal force?

Now, I should be able to do whatever to get him off of me, should I? Shouldn’t this apply to everyone? Being able to use as much force as possible in order to be able to get away?

thanks for reading!!!
srry if i had some had some typos
what is “reasonable force” defined as? like choking him to death? striking his family jewels? only being allowed to physically push him away (even though i might not be strong enough)? pinning him down?

vague stuff won’t exactly help me if I get into this situation (i hope i dont, honestly), but if I do, i’ll have very little time to think about it, and ill probably be exhausted and tired and whatnot, so I’d need to know the exact limits of how much force i could use? does that make sense?

i mean, each person has their own idea of what reasonable is; some might make him eat some lead, and others might only punch him a maximum of 4 times and only allow striking his groin twice per 1 minute? idk, too vague for me?

and uhh, lets say that this is a very aggresive ******.. and that i managed to push him away for 1 second, and managed to run 4 footsteps before he runs and pins me down again… does it change my situation? or no?
also, i felt like i should add this: at the time he is raping me, I feel no danger of death or dying, nor is there any indication of death or dying… in fact, during the entire time, he is whispering into my ear that he won’t harm me (while he ***** me)?

that might clear some of the hypothetical stuff up?
